Welcome to www.onlinefellas.com (the “Site”), operated by Online Fellas (“Online Fellas,” “we,” or “us”). By accessing or using our Site and related services (“Services”), you agree to comply with and be bound by these Terms of Service (“Terms”). If you do not agree with these Terms, please discontinue use of the Site and Services immediately.
1. Overview of Services
Online Fellas provides virtual assistant and related services to individuals and businesses. Our Services are subject to the following conditions:
- Services are offered exclusively to users aged 18 or older within the United States.
- All subscriptions are recurring and can be canceled as outlined in Section 6.
- Unused hours do not carry over to the next billing cycle.
- Any direct payment arrangements outside Online Fellas constitute a breach of these Terms and may result in termination of Services.
2. Access and Use of Services
Online Fellas grants you a limited, non-transferable, non-sublicensable, and revocable license to use the Services for internal business or personal purposes. By using the Services, you agree to:
- Use the Services only as permitted by applicable laws and these Terms.
- Prevent unauthorized access and notify us promptly of any security breaches.
You are prohibited from:
- Reselling, sublicensing, or redistributing the Services.
- Using the Services to engage in unlawful, fraudulent, or abusive activities.
- Reverse engineering, decompiling, or modifying the Services.
- Using the Services in a manner that disrupts its integrity or performance.
3. Payment and Billing
You agree to pay all fees associated with your chosen subscription plan. Payments are processed via a secure third-party provider. Failure to maintain valid payment information or non-payment of fees may result in suspension or termination of your account. Late payments may incur interest at 1.5% per month or the highest rate permitted by law.
4. Privacy
Your use of the Services is governed by our Privacy Policy. By using the Services, you consent to our collection and use of your data as outlined therein.
5. Task Requests
Each task request must be submitted individually via email, SMS, or phone. To ensure efficiency, we recommend sending separate communications for each task. Tasks must fall within the scope of our services as detailed on the Site.
6. Cancellation Policy
You may cancel your subscription at any time by contacting our support team at hello@onlinefellas.com. Cancellation requests must be submitted at least 24 business hours before the next billing cycle. Refunds for unused time are not provided.
7. Termination
We reserve the right to suspend or terminate your account for:
- Violations of these Terms.
- Abusive behavior toward staff or other users.
- Consistent requests exceeding the scope of your service plan.
In the event of termination, prorated refunds may be issued at our discretion.
8. Intellectual Property
All content, trademarks, and intellectual property associated with the Services remain the property of Online Fellas or its licensors. You may not reproduce, modify, or distribute any material from the Services without prior written consent.
9. Limitation of Liability
To the fullest extent permitted by law, Online Fellas is not liable for any indirect, incidental, or consequential damages arising from your use of the Services. Direct liability, if any, is limited to the total fees paid by you in the 12 months preceding the claim.
10. Indemnification
You agree to indemnify and hold Online Fellas harmless from claims, damages, or expenses arising from your use of the Services, violation of these Terms, or infringement of third-party rights.
11. Modifications to the Services
We may modify, suspend, or discontinue any aspect of the Services at any time without notice. These Terms will continue to govern any use of the Services.
12. Governing Law
These Terms are governed by the laws of the State of Ohio, excluding conflict of law principles. Any disputes will be resolved exclusively in the courts located in Ohio.
13. Miscellaneous
- Severability: If any provision of these Terms is found unenforceable, the remaining provisions remain in full force and effect.
- Entire Agreement: These Terms constitute the entire agreement between you and Online Fellas regarding the Services.
- Force Majeure: We are not liable for delays or failures caused by events beyond our reasonable control, such as natural disasters, public health emergencies, or internet outages.
